Engineering of a Doctrine in quest for power to Rule

By A Khokar   November 29, 2010

History tells us that Blasphemy law was introduced in late 1927 in the subcontinent during British Raj to thwart the communal riot and offences relating to religion between Hindus, Muslims, Sikhs, Buddhists and the new emerging creed of Christians. Accordingly Section 295 was introduced in Indian penal Code as part of Indian Act XLV of 1860. After the independence from British Raj and partition of subcontinent in 1947 Pakistan inherited the same Penal code and renamed it as Pakistan penal Code.

Original Section 295 forbids damaging or defiling a place of worship or a sacred object, which remained effective to thwart any communal riots during British Raj. After the creation of Pakistan this land with about 98% of Muslims mostly illiterate and conservative, the law kept on sitting idle till the time that political adventurist, Mr. Z A Bhutto with his ambitions to introduce socialist economic reforms wanted to devise the ways to mobilize the Religious conservative forces in the country to bring them in his fold.

After the debacle of Fall of Dacca in 1971, Pakistan was just coming out of its disastrous ordeal of seceding of its eastern wing of East Pakistan. The nation was utterly dismayed and in decent. There was a dire need that a recipe of unity for the nation be found. They say that all the new doctrines they take birth during the disastrous periods of nations. ZA Bhutto saw the opportunity to introduce some new doctrine which may incite theocratic and religious forces.

‘Give a dog a bad name and hang him’ is a most common feature of ‘sticking power of labeling’ in the ‘New Age doctrines’ and Mr. ZA Bhutto a shrewd ambitious man selected the most docile and humble creed of Ahmadies Muslims (Qadiyanis) in Pakistan to make them a scapegoat and new doctrine of impersonalizing the Ahmadiyya sect by labeling them as infidels was adopted.

Of course anti –Ahmadiyya sentiments were already found in certain religious circles as a latent current against Ahmadies for their particular belief of Mirza Ghulam Ahmed (as) who claimed to be the Promised Messiah and a Nabi. Mr. Bhutto found it a golden opportunity to put Ahmadies against the common belief of mainstream Muslims that there is no prophet after Prophet Muhammad (pbuh) the last of all the prophets. Rightly or wrongly, he exploited this version to get them declared a Heretic group in Islam. The religious parties foreseeing no future otherwise to be in power also saw it as a fair shake and joined hand with Bhutto to let this bill pass in the national assembly. Thus a Constitutional amendment called a Second Amendment Act of 1974 was made and Ahmadies (Qadiyanis) were declared— non –Muslim and thrown out of pale of Islam.

This move of Bhutto went well in the religious conservative masses in the country in his favour and he saw himself the most popular Muslim leader, at least in Asia. Now in public he was known as Qaid e Awam. He started dreaming even to lead the entire Muslim world and in 1980 called upon all the Muslim leaders to hold a Muslims Summit Conference of Islamic world in Lahore.

But soon his dreaming of a dream to live in a world of dreams was shattered that although now Pakistan was being recognized as the Fortress of Islam but another adventurist, his Armed Forces Chief of staff General Zia ul Haq came in his way and in a bloodless coup took over the rein of government from him. He declared a martial law in the country and a long dark age of dictatorial regime started. General Zia ul Haq to clear his own way eventually sent Mr ZA Bhutto down the gallows. He too used the recipe of making Ahmadies a scapegoat to further his ruthless regime. He passed several more Anti Ahmadiyya legislations and introduced various ordinances to subject them to his inhuman arbitrary laws and made it sure that Ahmadies being the blasphemous were reduced to the status of a third class citizen.

During the days of Military Dictatorship of Gen. Zia-ul-Haq, numbers of sections in the blasphemy laws were added in Pakistan Penal Code. In 1982, defiling or desecrating of Holy Quran was declared as offence with punishment of imprisonment of life (25 years) via section 295 B. In 1986, through 295 C the blasphemy of Holy Prophet Muhammad (PBUH) was declared offence with death penalty or imprisonment of life. These two sections are cognizable, non compoundable and non bailable. Furthermore, earlier in 1980, the blasphemous remarks or acts towards companion (SAHABA), family members of Holy Prophet (PBUH) was declared as an offence punishable with three years of sentence, in section 298-A. Whereas, in 1984, certain Muslim like activities and practices of Qadiyani group were declared unlawful via section 298 B and 298 C both with three years sentence.

During his tenure the religious fervency and extremism under the pretext of defending the prophet hood (Tahafaz e khatum e nabowat) of Prophet Muhammad (saw) was so escalated that life of Ahmadies in Pakistan was turned to misery. People felt free to take the law in their own hand and kill or torture Ahmadies. Destroying their businesses, properties and desecration of Ahmadies book libraries and Mosques became the common features. On the behest of Zia’s regime the fiery clerics were sponsored to deliver special sermons and to air the anti- Ahmadiyya rhetoric to dehumanize them. Hundred of the Ahmadies fled the country to escape the persecution.

Having achieved a desired swell in Islamic extremism in the country; a new force was seen being raised and trained as the Mujahedeen forces in Pakistan to fight a ‘Islamic Jihad’. The think tanks and policy makers of USA could gauge this development and potential of Mujahedeen and offered Pakistan on a price to push them as fodder into a long Afghan war on behalf of USA to dislodge Soviet Union.

Mujahedeen Jihadists were excessively funded and adequately equipped with US weapons to fight the Soviet Union forces in occupation of Afghanistan. The Mujahedeen Jihadist proved to be very ferocious fighters that within few years of time, Soviet Union a super power was forced to pack up from Afghanistan depleted and eventually it disintegrated. Pakistan was heftily rewarded for that. US now was the only Super power in the world. Invariably Pakistan as a blue eyed, now was in the hands of American. It has proved to be the most loyal mercenary who could fight any war for monies as a proxy.

Zia’s striking successes in Afghanistan also rekindled the old fire of Pan-Islamism and for the unification of Islam. He started considering himself Ameerul Momineen in Islamic world but—- not withstanding that he was simply working as a US proxy in Afghan war and not knowing that when the US proxies have passed their sell by dates; history tells us that Gallows always awaits them at the end. As expected, reportedly a covert operation came in play and General Zia was killed in a bomb blast while in the sky travelling in a military aero plane.

In Pakistan the Islamists were finding that use of Doctrine of blasphemy law had brought lot many successes in the country; from mobilizing the conservative Muslim masses and successfully running the dictatorial regime of Ziaul Haq and to the raising of the Mujahedeen forces to fight wars in the name of Islamic Jihad and mint monies. This was seen a great achievements to be carried forward. So all this —– didn’t end with the demise of General Zia Ul Haq.

In 1991 Mr. Nawaz sharif, the second successor prime minister after Zia ul haq, (brought into world of politics by Ziaul Haq); in order to keep the fervent religious parties in his pocket and also prove that he was a notch above his predecessor General Zia ul Haq; once again stirred the Ahmadiyya blasphemy issue and in order to show that he could take the most stringent step; he while upholding the punishment of death penalty in the blasphemy law, moved the bill for removal of ‘or imprisonment of life’ from Section 295-C of the Pakistan Penal Code.

Later it was only during the early days of Benazir Bhutto’s second government that this amendment bill was finally adopted. Again the government was in a hurry to push the bill because the house was about to be prorogued.

Leaving the state of Ahmadies and their sufferings in Pakistan aside; this law especially in the hands of sectarian war lord is the most bloody weapon that is ever wielded. … One may see that this weapon given in every man’s hand that they may let loose upon even his neighbour that he might not like and then—- blood and distress, turmoil, sorrow, misery, war, and destruction may sweep the face of the land around us.

But this weapon, these war lords may not like to abandon it so easily and any repealing effort may not go well. But one thing can certainly be done to take the sting out:–

We may not be able to repeal Blasphemy Law…. but we may certainly ‘Amend it… to Extend it’—to all the other religions that people lead…especially the Pakistan penal code sections 295B and 295C.

Punishing of the Blasphemous

By A Khokar    November 20, 2010

This is a known fact that when the Blasphemy laws were crafted in Pakistan; no one had in mind that this was being crafted in the best service of religion of Islam. History tells us of the vested interests of the few and it was simply a political motivated move in order to mobilize a political support of religious groups for which Ahmadiyya were made a scapegoat.

Courts as such passing the tough harsh sentences in respect of Ahmadies and others may not be solely blamed for awarding the punishments for Blasphemy. As the draconian law of Blasphemy does exist; so any case brought in the court. The courts perforce have to pass the judgement as per the law. It is not the courts but the legislative bodies; viz National assemblies and the Senate who are responsible for promulgation of such law; they are the real recreants.

We do know that Blasphemy law is basically Ahmadies specific but sorry for the other non-Muslim minorities like Christian and Hindus in the country that being non-Muslims, this Blasphemy law is extended to them also. One is horrified to look at the details of promulgated law that how a group of people are discriminated, placed defunct and pushed down as second grade citizen.

Salient of this law are as follow:

Pakistan penal Code (PPC) Description and Penalties

PPC.298A Use of derogatory remarks etc., in respect of holy personages——Three years’ imprisonment, or with fine, or with both

PPC.298B Misuse of epithets, descriptions and titles etc., reserved for certain holy personages or places, by Ahmadies——–Three years’ imprisonment and fine

PPC.298C An Ahmadi, calling himself a Muslim, or preaching or propagating his faith, or outraging the religious feelings of Muslims, or posing himself as a Muslim——-Three years’ imprisonment and fine

PPC. 295 Injuring or defiling places of worship, with intent to insult the religion of any class——–Up to two years’ imprisonment or with fine, or with both

PPC.295A Deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs———-Up to ten years’ imprisonment, or with fine, or with both

PPC.295B Defiling, etc., of Holy Quran——–Imprisonment for life

PPC.295C Use of derogatory remarks, etc; in respect of the Holy Prophet—–Death and fine

When this law is seen in the light of Islam; one is astound and fail to comprehend that how could the able Legislative Bodies… i.e National assembly and senate of Pakistan be so clue less as to pass a law but are not aware of the broader scheme of God in respect of religion of Islam that God shuns any kind of discrimination of peoples following the older religions that once they were also called by GOD as the Divine religions.

After the dawn of Islam there were scores of other active old religions including the divine religions [1] then and God Almighty being well aware of the fact that they will take considerable good time to come forward after shedding their old beliefs and to accept and know the reality of Islam. In this regard, Allah Jalashana hou very specifically says:

[2:62] “Surely, the Believers, and the Jews, and the Christians and the Sabians — whichever party from among these truly believes in Allah and the Last Day and does good deeds — shall have their reward with their Lord, and no fear shall come upon them, nor shall they grieve.”

We also need to understand what all it take for the ‘Matter of Belief’ that people posses toward their creator God Almighty and how the people on this planet follow certain rituals to gain the nearness to God. This Matter of belief happens to be a unique phenomenon that one may experience it in his/ her life. People may come to terms with certain belief within the confines of their knowledge, culture, geography or the environment and somehow this belief and practices of certain rituals becomes so dear to them that they will negate everything else but the belief.

For instance Christians they believe in Jesus (as) and in his sheer love, have rather elevated his status from a prophet of God to be the son of God and even the God himself. So much so that they think that Jesus is the only saviour of this world and atonement of all the peoples may only come through him.

In persuasion of their belief; Christian they ought to negate anybody other than Jesus. To defend their prophet Jesus at all cost becomes incumbent upon them…. so anything they say or demonstrate; for others it may look Blasphemy or whatever—- but for them … they are simply defending their own belief.

Islam happens to be the latest in scheme of religions of God. God Almighty declares in Quran that He has eventually selected Islam as religion for the whole mankind. The believers of Prophet Muhammad (saw) they also believe that God Almighty has told them through Quran that after the advent of Prophet Muhammad (saw) all the previous denominations including Christianity of Jesus and the Jews and all the old denominations; they stand superseded.

Muslims the flag bearers of Islam have got a great job at hand. They ought to sure know this as what all is there at stake. They are required to show their magnanimity, a special perseverance and wisdom that how best they could convince others that Islam is here which validates the truth of the older religions and ask them to hearken; join the Muslim’s ranks and files for their atonement. Islam being the latest in Divine religions; is just not the religion of Muslims only but Islam is every body’s religion.

This world does not need any Blasphemy law of any kind coming out of the House of Islam…the forbearance of Islam demands from the Muslims that they need to prove that how they excel all others. As they are the Best and are the notch above the rest on this planet.

Allah vouchsafes for the Muslims and says: [3:110] “You are the best people raised for the good of mankind; you enjoin what is good and forbid evil and believe in Allah…..”

Concept of Punishment in an Islamic welfare state

By A Khokar   November 19, 2010

The concept of ‘western new world order’ bases on formulating a Transatlantic Corporate Governance. All the western countries form part of this corporation to be governed under common political system and the principal economic functions, as banking, industry, or labour, are organized as corporate unities.

The New Role of individual Governments in Corporate Governance remains to lead a collective political system in respective countries. As for freedom, it may soon cease to exist in any shape or form. Living will depend upon absolute obedience to a strict set of arrangements, which it will no longer be possible to transgress.

In an ideal corporate society, mothers and fathers would produce potty- trained, civilized, responsible new citizens while government and corporate leaders would provide a safe, healthy, economically just community.

All the countries spread on the other half of the planet from where the transatlantic corporate governments draw their mineral and human resources to run their economies especially the unlettered Islamic Block, as such remain the major issue of their foreign policy. Western Corporate media is the biggest tool available in the hand. It focuses on perhaps this most elusive issue in this field; that how best the military and other western underground forces employed in and around the Islamic block to subjugate the peoples be depicted as their saviors in order to bring them in western fold.

Somehow the corporate western media is seen very successful in depicting a bad Image of Islamic bloc that perhaps people under orthodox Islamic laws are living their lives under oppression. Freedom of speech has no meanings and they are rather coerced in to it, against the will and wishes of commoners.

In view of perpetual onslaught of western corporate media, the infamous Taliban orthodoxy has become another name of Islamic states. The projected image of Islam is most horrible that Islamic state is; where somehow woman is a demon and that state laws encourage cutting the hands and limbs for petty crimes.

Unfortunately certain Islamic extremist groups keep on doing the job of putting ready oil on the fire—-not withstanding that to enforce any award of strict punishment as per the broader scheme of Islamic jurisprudence means that; first and foremost we need to have established an Islamic welfare state where by all the aspect of life and welfare of the masses is taken care of. In the absence of all this; simply to talk of certain Islamic laws and show that how life could turn miserable in an Islamic State for the people where by their hands and limbs are cut for petty crimes—-may be most cynical approach.

Rather a true picture is required to be painted that under Islamic way of life and its jurisprudence; the life pattern must become so attractive and filled with peace and plenty that there a need may never arise that people indulge in petty crimes like stealing and carrying out theft and are punished. Ironically; to depict a repulsive picture of Islam which looks so horrible by narrating certain verses of Quran may only create a fear and terror in the hearts of people— this is the most absurd practice under taken, by the extremists’ religious groups in Islam.

In this regard the Verse [5:38] of Surah Al- Maidah of Quran, is widely discussed and referred to, which says:-

[5:38] “And as for the man who steals and the woman who steals, cut off their hands in retribution of their offence as an exemplary punishment from Allah. And Allah is Mighty.”

The punishment prescribed for stealing may appear to be too severe but human experience shows that punishment; if it is to be deterrent should be exemplary. It is better to be severe to one and save a thousand than to be indulgent to all and ruin many. He is certainly a good surgeon who does not hesitate to amputate a rotten limb to save the whole body.

In the heyday of Islam there were extremely rare cases of the cutting of hands of thieves because the punishment prescribed was deterrent and was put in force. Even today incident of theft are very rare in Saudi Arabia where punishment for theft prescribed by the Quran is in force.

But in order to arrive at right understanding of the nature of punishment, it is necessary to know both the literal and metaphorical use of two Arabic words used herein the verse: viz., “Qat and Yad” . The Arabic expression; ‘Qata a-hu bil hujjatti’ means he silenced him with arguments (Lane). And Yad among other things means the power and capacity to do certain things. Thus the ‘Qata’a Yada-hu’ metaphorically means, he deprived him of the power to do the thing; or he restrained him from doing it. We may also see verse [12:31] which describe an incident and same wording ‘Qat’ is used that when seeing after Joseph’s saintly and handsome visage women were so stuck with it that while peeling oranges they cut their fingers.

Anyhow, in view of the signification of the two words viz., “Qat and Yad “ the Arabic expression used in the verse mean— deprive them of the power to commit theft or employ any practical means calculated to restrain them from committing theft. Taking the verse literally the punishment prescribed in the verse is maximum punishment and maximum punishment is awarded in extreme cases only. The lesser punishment being the adoption of any practical means by which the offender is deprived of the capacity of, or restrained from, committing the offence.

In awarding the punishment the nature and scope of all the attending circumstances are also to be taken under consideration. If jobs and opportunity of sufficient earning is available to the people; hardly a requirement arises that common men may indulge in committing such offences as stealing except the habitual criminals.

Who is Afraid of Sharia Law?

By A Khokar    November 16, 2010

Sharia law, which derives from the teachings of the Quran and from Sunnah (the practice of the prophet Mohammed (saw)), is implemented to varying degrees in different Islamic countries – from the beheadings of Saudi Arabia, to the relatively liberal social mores of Malaysia.

The word Sharia means “the path to a watering hole”. It denotes an Islamic way of life that is more than a system of criminal justice. Sharia is a religious code for living, in the same way that the older books like Bible offer a moral system for Christians.

It is adopted by most Muslims to a greater or lesser degree as a matter of personal conscience, but it can also be formally instituted as law by certain states and enforced by the courts. Many Islamic countries have adopted elements of Sharia law, governing areas such as inheritance, banking and contract law.

In Pakistan, certain religious group show their special craving toward adapting Sharia law. Although the masses too may not have any hesitation toward adopting these laws or be taken that they are somehow afraid of Sharia law. But they are certainly afraid of the era of darkness which may follow at the hands of religious extremists usually seen applying their tactics of fear and terror in this country. Extremists, they keep on demonstrating their dormant acts, day in and day out through coercion, arson and indiscriminate killing. People fear that peace and serenity of their society may be hijacked and they may find themselves engulfed in a state of utter chaos and anarchy.

All this may not convince people to go ahead for Sharia. they would certainly  like to see some good  model of Islamic society run under Islamic Sharia law but sadly they may find none  out there.

This is very much desirable that Islamic Sharia laws may be portrayed with goodly face but till the time the prevalent general perception attached to Islamic orthodoxy known as Talibanisation is not successfully erased, where people are fearful that in the name of Sharia law religious extremist are likely to hijack their existing systems as well as their right of freedom of life and other businesses by force and replace it with utter orthodoxy and make their lives miserable.

In fact in a state run under Sharia laws; People are looking for new Islamic heavens and a new earth, wherein dwelleth righteousness. Wherefore people look for such things as to be diligent that they may find the real peace and justice without— any black spot, and blameless.

On the other hand present day Muslims are found so much divided and seen so split on their faith matters and other issues of Islamic jurisprudence that to construe an agreed ‘Sharia law format’ which may be acceptable to all the Muslims— is deemed next to impossible.

The Muslim world and the Transparency International report

A report: As the Muslim world implements strict laws to ban alcoholism, adultery, or even free speech, one wonders: where are the laws against corruption?

It is embarrassing to note a fact in the Transparency International report that top five most populated Muslim countries, Indonesia, Pakistan, Bangladesh, Nigeria and Egypt, fell under the miserable range of 2.0 to 3.9 and only four out of the 48 Muslim-majority countries made it above 50.

As the Muslim world implements strict laws to ban alcoholism, adultery, or even free speech, one wonders: where are the laws against corruption? The leaders of these countries could learn a thing or two about curtailing corruption from Denmark, New Zealand, or Singapore, which all shared the top spot. Question may arise that why should the Muslim world learn from these so-called infidels?

Well, because of what the Prophet Muhammad said: “a word of wisdom is the lost property of a Muslim. He should seize it wherever he finds it”.

Obama lands in India with prospect of Jobs creation back Home

By A Khokar     November 07, 2010

In the age of ‘economic depression’ in the world; all the major western industrial countries engaged in manufacturing, in order to reduce their production cost, are forced to ‘out sourcing’ and avail cheap labour. Most of the companies have shifted their manufacturing units to third world countries. Philippines and India are the known leading countries in offering them the services on the very cheap rates. Western banks and other communication firms have also shifted their call services centres to these countries. In this connection; India is known as ‘land of call centres’.

But after China; Indian economy is the most vibrant economy. It is growing at a fast pace touching a record perpetual growth of some double figures in Asia and has become the fourth largest economy in the world. US as well other western countries are seen pursuing the wealthy Asian companies to invest in their countries.

Post-liberalisation, India has not only witnessed tremendous economic growth, but has also experienced something which was more of a distant dream. Indian economy, within a span of less than two decades has touched the trillion dollar mark and its stock markets are all set and surging both in terms of scale and scope to storm the lists that may feature the “best” of the world. But sadly there is down side of Indian economy that as it is evident from the fact that in its social sector, in spite of the surging number of billionaires in the country, the fate of Indian work force has not changed much. There is a huge disparity; one just needs to compare this prosperity at the top of the pyramid with the misery at the bottom.

Although India and Indian companies are making their positions formidable in various esteemed sectors but they are unable to model their commitment in the way today’s global companies view their duty towards society. India needs to look into this aspect of sharing of the earned profits and enhancing the allocation of funds towards the health and family welfare of workers to minimise the social imperatives.

Obama has landed with his hefty entourage of CEOs in India with  a long term plans that—possibly how the Indian growing economy be transformed into a society of a consumers by encouraging them the reformation of their ‘welfares of work force’ in India and increasing the purchase power of Indian middle class. US is likely to tie certain trade knots with India and to pursue the Indian companies to invest in US; so that US is able to export US made consumer goods to India.

Obama is pinning high hopes that this plan may revive the US failing economy and thus increase the prospects of creation of jobs for the jobless back home.

Why US Drones are attacking us?

By A Khokar         November 02 , 2010

Pakistan is in the thick of War against terror and has suffered the most in terms of the war causalities of Pak army soldiers, indiscriminate killing by drone’s attacks in northern area and thousands of civilians that they are killed by bomb blasts and suicidal attack in public places—since carried out by the CIA supported Tehrik e Taliban in Pakistan (TTP). There is no estimate available as how many children ladies and men are maimed in these savage attacks and how much of the properties is lying totally destroyed……… but there is a unique phenomenon of this war that Pakistani general masses are not told that:

  • Why US Drones are attacking them and why they are not shot down by our air force or why our ground forces are hesitant to engage them by surface to air missiles or anti air craft guns.
  • Why Pak army since deployed in Waziristan is seen failing in eliminating TTP and why after all their savage attacks are not condemned by certain religious groups in Pakistan.

Matter of the fact is that in the bigger game of US; Pakistan has agreed on a price to act as decoy and to carry out all such tasks which may facilitate our master—US to carry on with his plans— It is all a paid up job and Pakistan receives a handsome amount for this; may it be that our sovereignty or borders are violated or thousands of person are killed…..or they are maimed as collateral damage. Pakistan government and its military are very well paid.

So please be warned that Pakistan has been sold out on a paltry price…. we all are now somebody else’s property—so please do not complain. Just sit back and better enjoy…this inevitable molestation.
